Deputy Governor of Ondo State, Lucky Aiyedatiwa, has taken legal action by filing an appeal against the ruling of the Akure High Court concerning his impeachment proceedings.
The notice of appeal was officially lodged at the registry of the Akure High Court on Tuesday, with his legal counsel, Ebun-Olu Adegboruwa, leading the charge.
The appeal, which comes in the wake of the court’s decision, highlights five distinct grounds on which the Deputy Governor seeks to challenge the court’s ruling.
Among the grounds of appeal,
“is a complaint that the judge erred in law in combining the hearing of his application for an amendment together with the application of the House of Assembly challenging the jurisdiction of the court, which amounts to a denial of his right to fair hearing.”
One notable point of contention in the appeal is the assertion that the judge presiding over the case erred in deeming it an abuse of the court’s process. The Deputy Governor’s legal team argues that the parties involved and the subject matter of the case in Akure are fundamentally distinct from those in the corresponding case in Abuja.

In light of these grievances, the appellant has formally requested the Court of Appeal to overturn the ruling of the judge in the Akure High Court.
To provide context, Deputy Governor Aiyedatiwa initiated legal proceedings against his impeachment on September 25, 2023. Subsequently, on October 6, 2023, the court heard arguments from the legal representatives of the involved parties and delivered its ruling on October 10, 2023, ultimately concluding that the case constituted an abuse of the court’s process.
